Terms & Conditions
All rentals are subject to Terms & Conditions. Clients will be asked to confirm acceptance of these Terms & Conditions for before submitting any vehicle reservation for hire. These Terms and Conditions are a part of the Rental Agreement and will be issued or attached to each rental agreement. Confirming acceptance certifies that you have read, agree and understand all terms and conditions stated for your rental agreement.
All rental agreements will be governed by the laws of the Commonwealth of The Bahamas.
DRIVERS/WHO MAY DRIVE THE VEHICLE
Drivers must each have reached the age of twenty-five (25) years old and be the holder of a valid driver’s license issued in their country of residence, which he or she has held for at least two (2) years. You agree that we have the right to verify that your license has been validly issued and is in good standing; and that we may refuse to rent to you if your license has been suspended, revoked, otherwise restricted in any way, or if your driving record is unsatisfactory to us.
We reserve the right to deny rental based upon information about your license status or driving record provided by the Motor Vehicle Department of the jurisdiction that issued your license.
VEHICLE USE
You and any Authorized Driver must only use the vehicle on a road that is properly formed and constructed as a sealed, metal, or gravel road. Hirer will not leave the vehicle unattended and fail to lock all doors, windows, trunk or to remove the keys from the vehicle. The hirer shall not use the vehicle while under the influence of alcohol or uncontrolled substance or for any illegal purpose whatsoever; transport goods which are prohibited or dangerous; transport passengers or property for hire, money or reward; to tow or push anything; to be operated in a test, race or contest, recklessly. It is strictly forbidden for Hirer or any Authorized Driver to overload or exceed seating accommodation, transform the vehicle, modify its technical features, add or remove any parts or accessories, take or attempt to take the vehicle to Trinidad except permitted in writing by the Owner, which may be withheld at Owner’s discretion. You also agree that all vehicles are non-smoking and for failure to comply with this rule a fee of $50USD will be charged to have the same cleaned.
VEHICLE RETURN
You must return the Vehicle to our rental office or other location we specify, on the date and time specified in this agreement, and in the same condition that you received it, except for ordinary wear. Service to the Vehicle or replacement of parts or accessories during the rental must have our prior approval. You will check and maintain all fluid levels including the brake fluid level in the master cylinder.
VEHICLE DAMAGES
RESPONSIBILITY FOR DAMAGE OR LOSS; REPORTING TO POLICE. You are responsible for all damage to or loss of the Vehicle, loss of use of the Vehicle while it is being repaired, diminution of the Vehicle’s value caused by damage to it or repair of it, missing equipment, and all administrative costs we incur due to damage to, or loss of, the Vehicle regardless of whether or not you are at fault, unless this responsibility is otherwise limited by law. You must report all accidents or incidents of theft and vandalism to the police as soon as you discover them. You must also report all accidents or incidents of theft involving the vehicle to office immediately.
EARLY RETURN POLICY
Unfortunately, we are not able to refund customers if they choose to return their rental vehicle earlier than the scheduled contract times. This is mainly because when your vehicle is booked we turn away all other rental requests to honor your booking.
CANCELLATION POLICY
If a vehicle rental is prepaid via our website platform or Lucayan branch location, the following conditions will apply for all refund or cancellation requests.
Prepaid Bookings Cancellation
If you cancel your booking more than 1 day or 24+ hours before your specified pick-up time, you will receive a full refund minus a cancellation fee of $75.
If you cancel your booking less than 1 day or 24 hours before your specified pick-up time, you will receive a full refund minus a cancellation fee of $100.
If the total refund amount is less than the cancellation fee no refund will be given.
EXCESSIVE DIRTINESS AND SMOKING
Absolutely NO SMOKING in vehicle. Subject to immediate lost of deposit not exceeding $250.
If a vehicle is returned in a condition that is deemed excessively dirty. This includes but is not limited to excessive beach sand, excessive garbage, excessive seat water damage, any internal or external vandalism, or any pungent smell that is difficult to remove (such as fish water). Hirer agrees to a fee of $75 to be automatically charged to the credit card that is on file.
COLLISION DAMAGE WAIVER (CDW) POLICY/COVERAGE
Collision Damage Waiver (CDW), covers bodywork damage cost to Lucayan Car Rental vehicle should a Renter collide with another car.
CDW is not insurance but merely a waiver between the Renter and Lucayan Car Rental to waive financial responsibility for any damages occurred during an accident in our rental vehicle.
It is important to note that this policy is only meant to cover damage to the vehicle itself, not liability-related expenses. Our Collision Damage Waiver does not cover liability expenses such as damage to other vehicles, property or bodily injury. It also excludes accidents and incidents caused by risky behavior such as speeding, reckless or off-road driving, negligence and driving under the influence.
What is covered by Collision Damage Waiver.
CDW only covers damages to the exterior bodywork of the car in the event of a collision with another vehicle up to the value of the rental vehicle itself.
What damage is not included in CDW coverage.
Damage to –
· Glass (all windows and mirrors)
· Tires & wheels
· Interior trim (seats, carpet, and all interior materials)
· Undercarriage/Suspension
· Your belongings (anything left in the car, including the trunk or glovebox)
· Lost keys
· Transmission
Mandatory requirement to enact waiver after an accident has occurred.
Presentation of a Notice of Intended Prosecution from The Royal Bahamas Police Force given on the scene of an accident stating and showing occurrence of an accident during rental period in which CDW was purchased and paid for in full. This document must be presented/given to Lucayan Car Rental office within 48 hours of a collision with another vehicle.
RENTAL AGREMENT VIOLATIONS
You agree to properly operate this vehicle. If any of the following acts are committed, any coverage provided to you will be voided: (a) Operation of the Vehicle by an unauthorized driver; (b) Violation of any provision of this Agreement while operating the Vehicle; (c) Driving while intoxicated or under the influence of drugs, alcohol or other substances which would impair driving ability; (d) Reckless driving of the Vehicle to include, among other things, off regularly maintained roadways, to carry hazardous or explosive substances, to carry hazardous waste of any kind, to transport weight in excess of the vehicle’s maximum payload capacity, where insufficient clearance or height or width exists, improper loading; (e) Transporting more passengers than number of seat belts or transporting passengers outside of the passenger compartment; (f) Using the Vehicle to participate or act or assist in any activity that violates any law, rule, or regulation; (g) Using vehicle to carry persons or property for hire; (h) Using Vehicle to engage in an organized or any other speed contest; (f) Using Vehicle to tow or push any other vehicle, trailer or other object; (j) Operation of Vehicle by person who has used false or misleading information to obtain the Vehicle; (k) Operating the Vehicle outside the islands of New Providence and Paradise Island; (l) Leave the Vehicle and fail to remove the keys or close and lock all doors, windows, and the trunk and the vehicle is stolen.
